WHAT FEES WILL I PAY?

On the sale of your home you would traditionally pay a commission fee to an estate agent and a separate fee to your solicitor but we can offer you a sales and legal service for one single, competitive fee. The purchase price of the property that you wish to buy will decide the amount of stamp duty land tax you pay.

The rates are

WHAT ARE SEARCHES?

These cover searches at the Land Registry for your Solicitor to discover all the details of the legal title, enquiries with the local authority about planning, road schemes, compulsory purchase, environmental issues and, depending on where the property is, searches to discover whether it will be affected by mining operations.

A search with the local water company will be needed to check whether there is mains water and mains sewerage.

An environmental search will reveal whether the property is likely to suffer from flooding or contamination, past operations on the land or the land nearby.

Your solicitor will advise you which searches should be made.

You are always advised to have your own physical survey carried out when buying a property. This is not the same thing as a mortgage valuation.

We can recommend a qualified surveyor to carry out a survey on your behalf to reveal anything that you, as a purchaser, would need to know before signing a contract to buy.

WHAT HAPPENS WHEN I SIGN THE CONTRACT?

Having made all the necessary searches and enquiries and given you advice, if you are happy with the result of your survey your solicitor will arrange for an exchange of signed contracts between seller and buyer at which a deposit, usually 10%, is payable. On the exchange of contracts you are committed to buy or sell, as the case may be.

A date for legal completion is fixed on which the balance of the price is payable. On that date the seller must move out, allowing the buyer to move in.

HOW LONG WILL THIS TAKE?

Allowing a reasonable time for the legal work and searches to be carried out (the local authority can take at least 2 to 3 weeks to answer enquiries) the answer to this largely depends on the arrangements which the buyer and seller make for any related sale or purchase and mortgage requirements. Garner Canning Estate Agents will work closely with your solicitor to iron out any difficulties which arise along the way in order that completion can be in the quickest possible time.

WHEN DO I PAY THE FEES?

You may be asked to make an advance payment for fees for some of the searches – your solicitor will ask you to pay for the remaining fees and expenses before completion.
